Terms of service

What this site is, and what it isn't

The Discover the Qu'Appelle is a listings website. It publishes information about local businesses, events and places, lets people leave reviews, and passes booking enquiries along to the business they're addressed to.

We are an intermediary. We do not sell, supply, prepare, deliver, host, guide, repair, or provide any of the goods or services listed here. Every business on this site is independent. It is not our agent, partner, employee or franchisee, and we have no control over how it operates.

If you contact, visit, book with, buy from or otherwise deal with a business you found here, that dealing is entirely between you and that business. Your contract is with them. Your claim, if something goes wrong, is against them. We are not a party to it, we do not guarantee it, and we do not stand behind it.

Information on listings comes from other people

Listing details — hours, prices, phone numbers, descriptions, photos — come from the business itself, from public sources, or from what visitors tell us. We publish it. We do not independently verify that it is accurate or that it stays accurate.

Check before you travel. A business can change its hours, move, or close without telling us. Where a listing has no hours we say so rather than guessing, but a listing that shows hours can still be out of date.

If you find something wrong, tell us at jaiscollins2@gmail.com and we will look at it. Business owners can claim their listing and correct it themselves, free.

Reviews and other things visitors post

Reviews are the opinions of the people who wrote them. They are not ours, we do not adopt them, and publishing one is not a statement by us that it is true.

  • Review places you have actually been. Don't review your own business, a competitor's, or write on someone else's behalf. Writing or commissioning a fake review is against these terms and, where it is done to promote a business, is a deceptive marketing practice under the federal Competition Act.
  • If you received money, a discount, a free product or service, an entry in a contest, employment, or any other benefit connected to a review, you must disclose that connection clearly in the review. Businesses must not offer an incentive on the condition that a review be positive, and must not hide or discourage honest negative reviews.
  • You keep ownership of what you post and grant us a non-exclusive, royalty-free licence to display it on this site. Only post material you have the right to post.
  • A business owner can reply publicly to any review and can report one for moderation. Reporting temporarily hides it while an administrator looks. A review is not removed for being negative. It is removed if it is about the wrong business, contains personal information or abuse, or is plainly fabricated. Every decision is recorded with a reason.
  • We can remove any content, at any time, without notice, and are not obliged to publish or keep publishing anything.

Reporting content — how to reach a person

If something published here is defamatory, infringes your copyright, discloses personal information, or is otherwise unlawful, email jaiscollins2@gmail.com with the page address, what specifically is wrong, and how to contact you. We will review it promptly and remove or amend what needs it.

This route is deliberate. It is faster and cheaper than a legal letter, and it is how most problems get fixed.

Bookings and enquiries

A booking request sent through this site is a message to a business, not a reservation. The business decides whether to accept it. We deliver the message and email you their reply. We take no payment or deposit on their behalf, we hold no money for them, and we are not responsible if a business does not answer, declines, or fails to honour something it agreed to.

Listing a business

  • You may only claim or manage a listing for a business you own or are authorised to represent. We may ask you to prove it.
  • You are responsible for everything on your listing being accurate, lawful, and yours to publish — including that you hold whatever licences, permits, insurance and registrations your business requires. We do not check any of that.
  • You are responsible for your own dealings with your customers, including refunds, complaints, safety, and compliance with consumer law. A listing here does not make us part of your business.
  • We may decline, edit, suspend or remove a listing at our discretion — for inaccuracy, for a business that doesn't exist, or for content that doesn't belong on a community directory — and we will tell you why.

Advertising and paid placement

Some placement on this site is paid for. Wherever that is the case it is labelled — “Paid placement” or “Sponsored” — next to the placement itself.

Paying buys position and nothing else. It does not buy a rating, a review, the removal of a review, a different moderation outcome, or our endorsement. Ratings come from customers. Editorial and moderation decisions are made the same way for advertisers and non-advertisers.

The Homepage Spotlight

  • $49 per week in Canadian dollars, plus applicable tax. A week runs 7 days, Monday 12:00 am to the following Monday 12:00 am, Saskatchewan time. One business holds it in any given week.
  • It does not renew unless you switch on automatic renewal. If you do, we book and charge for the following week while the slot is still free — if another business has already booked it, your renewal is skipped and you are not charged.
  • You can turn off automatic renewal at any time, from your dashboard. It takes effect immediately and stops all future charges.
  • Turning off renewal does not end the week you already paid for — you keep the placement until that week finishes.
  • A week that has started is not refunded, in whole or in part, because the placement has already run.
  • A week that has not started yet can be cancelled for a full refund, up until it begins.
  • If we fail to run a placement you paid for, you get that week's payment back. That is not affected by anything above.

Featured and Premium listings

  • Featured is $99 per month and Premium is $199 per month, in Canadian dollars plus applicable tax. Payments are processed by Stripe; we never see or store your card number.
  • These renew automatically each month until cancelled. We email a reminder about 30 days before each renewal.
  • You can cancel at any time. Cancelling stops the next payment and you keep the plan until the end of the period already paid for. We do not pro-rate a partial month back.
  • If we remove a listing for breaking these terms, the remaining period is not refunded.

We do not promise any particular number of views, clicks, enquiries or customers from advertising here. Your dashboard shows what actually happened.

Other companies' services and links

The site uses third parties to work — Stripe for payments, a mapping provider, an email service, a weather service, and hosting. It also links to businesses' own websites and social media. We are not responsible for those services or those sites, and their terms and privacy practices are their own. See the privacy policy for who receives what.

The site is provided as it is

We work to keep the directory accurate and available, but we provide it “as is” and “as available”. To the fullest extent the law allows, we exclude all warranties, conditions and representations that are not written down here — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • a listing's details are current or correct;
  • a business is still trading, open, or any good;
  • a review is truthful or written by a genuine customer;
  • the site will be uninterrupted, secure, or free of errors.

Limitation of liability

To the fullest extent the law allows, we are not liable for any loss or damage arising out of:

  • anything a business listed here does or fails to do, including goods or services that are defective, unsafe, not supplied, or not as described;
  • inaccurate, incomplete or out-of-date information on a listing;
  • anything posted by another user, including reviews;
  • a journey made, a booking attempted, or money spent in reliance on this site;
  • the site being unavailable or losing data.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or goodwill, even if we were told they were possible.

Where we are liable despite the above, our total liability for all claims is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty Canadian dollars.

You cover us for what you put here

If you post content or run a listing on this site, you agree to indemnify us — that is, to cover our reasonable losses, costs and legal fees — for any claim brought by someone else that arises from what you posted, from your listing being inaccurate or unlawful, or from your dealings with your customers.

What these terms cannot do

Some liability cannot be excluded by a term on a website, whatever it says. We would rather tell you where the line is than pretend it isn't there:

  • Nothing here excludes liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence.
  • Nothing here removes rights you have under Saskatchewan's Consumer Protection and Business Practices Act or other consumer legislation that applies to you, and statutory warranties that Act gives you cannot be waived.
  • If you paid us for advertising and we fail to run it, that is our failure and you get that payment back. No clause above changes that.
  • Nothing here affects your rights under privacy law. See the privacy policy.
  • If any part of these terms is found unenforceable, the rest still applies.

No accounts, and using the site fairly

There are no public accounts on this site. Visitors can browse everything without signing in, and a business owner claims a listing by proving they can answer the business's own phone number — the claim form asks for a name, an email address and a number to call, and sending it means you agree to these terms and that the details you gave are accurate.

Don't use the site to break the law, to scrape it at a volume that degrades it for other people, to claim a business you have no connection to, or to reach anything you are not entitled to.

You can stop using the site whenever you like and ask us to remove a claim or listing you are responsible for — the privacy policy says what happens to content already published. We may refuse or undo a claim that breaks these terms, and we will say why.

Changes to these terms

We may update these terms. The date at the top changes when we do. If a change materially affects people who have paid us, we will email them before it takes effect, and it will not apply retroactively to advertising already bought.

Governing law and contact

These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there, and the courts of Saskatchewan have jurisdiction. Questions go to jaiscollins2@gmail.com.
